Dearie Law Group Secures $6 Million Settlement in Medical Malpractice Case Against U.S. Government

Attorney Ray Dearie and Attorney Drew Lombardi reached a $6 million pre-trial settlement with the United States government related to medical malpractice at a federally funded health care facility.

The case stemmed from a 2020 primary care visit, when Dearie Law Group’s client consulted with a Doctor of Osteopathic Medicine (D.O.) regarding classic symptoms of diabetes.  Ray Dearie and Drew Lombardi argued that results from a blood draw taken at that consultation revealed an unmistakable diagnosis of diabetic ketoacidosis – a potentially life-threatening condition.  According to Dearie Law Group’s investigation, the doctor reviewed those blood draw results not long after the consultation.  However, instead of counseling Dearie Law Group’s client to seek emergency medical care, the doctor scheduled a follow-up appointment for later in the week when she returned from her scheduled days off.  Dearie Law Group’s client tragically passed away from diabetic ketoacidosis one day before that follow-up appointment.

The United States government denied that its doctor acted negligently throughout the litigation.
